對婦女人權的保護，從公法領域進入私法領域，係CEDAW相當大的突破，相較於其他國際人權憲章，此為CEDAW最大特色所在。CEDAW在台灣私法領域的落實，主要表現在民法親屬篇。此外，為明定CEDAW在台灣法律上效力，內政部已提出CEDAW施行法草案，等立法院三讀通過總統公布之後，在台灣，將有第三個國際公約國內法化的實例，凡此，更可彰顯台灣保障婦女權益的決心。本文在CEDAW施行法草案立法正式通過前，先行檢驗CEDAW在民法親屬篇的實踐及現行法尚未完全落實之處，應有助於CEDAW施行法通過後的法規調適及修正。

From the field of public law into private law areas, to protect human right of woman is the main trait of CEDAW. Compared to other International Bill of Human Rights, this is the most significant feature of CEDAW. CEDAW implementation in the field of private law in Taiwan is the Civil Law, mainly in family law. In addition, to stipulate the CEDAW’s effectiveness of the law in Taiwan, Ministry of the Interior has proposed the draft on CEDAW implementation. After the Legislative Yuan enacted and the president announced, Taiwan will have the third example which international convention changes into domestic law. Above all, it can highlight Taiwan’s determination to protect the rights of women. Before CEDAW Implementation Draft becomes legislation, this paper priors to testing CEDAW in family law practice and discussing the existing law not completed. It should contribute to the adjustment and correction regulations after the passage of CEDAW Implementation.
