本文以臺中市私立區域醫院級以上（含醫學中心）之醫療機構為調查標的，針對這些醫療機構之相關法律風險來源、法律風險管理運行模式、成效評估與進行法律風險管理之機構組織等問題，對相關醫事人員進行抽樣訪談與研究。並根據本研究，獲致三點結論：1、加強醫病溝通係有效降低法律風險發生之重要因素。2、爭取避免以訴訟方式解決醫療糾紛為法律風險控管之主要目標。3、目前醫院評鑑項目有利於降低法律風險，但如何透過管理或立法避免病患方非理性的干擾，則為日後相關研究不可忽視之重點。

This paper focus on an investigation of legal risk management of Taichung City private regional hospitals (including the Medical Centers). The subject of investigation includes how these medical institutions identify the sources of legal risk, the operation mode of legal risk management, the effectiveness assessment, the structure of risk management organizations and other legal issues, interviewing the relevant medical personnel in those medical institutions. Three conclusions are made by the above study: (1) Strengthening the doctor-patient communication would help to reduce legal risk. (2) Seeking to avoid litigation is the main target to resolve medical disputes in legal risk management of the medical institutions. (3) Currently hospital accreditation programs would help to reduce legal risks; however how to avoid irrational interference on the side patients through management or legislation, should be an important study issue in the field of medical dispute resolution.
