The 《 act de gouvernement 》 is a type of decision made by the administrative authority which benefits judiciary immunity. The existence of such an act casts doubt on the ideal of the 《 rule of law 》, which holds that all administrative decisions first and foremost controlled by the courts. This study aims to analyze the nature of some decisions made by the administrative authority and the problem of justiciability in French public law. The major theories of in mainstream discussions will be introduced in the first part of the paper. The practices which result from the decisions of the administrative court will then be examined in the second part. Finally, this paper will attempt to offer several ideas about directions for further research.
