在邁入數位匯流的時代，我國電信管制規範的架構自電信自由化以來，歷經十年考驗，始終維持著目的事業綿密管制的規範架構，並「以電信機線設施有無」作為電信事業分類規範基礎，將電信事業區分為特許制之第一類電信事業，以及，許可制之第二類電信事業，進而展開一套綿密的產業管制規範，其管制框架則以市場進入規範占有決定性地位。故本文首先介紹電信管制之法律基礎，進而介紹我國既有電信管制法令之市場進入規範，並檢討歷經十年管制歷程的轉換，相關管制措施與市場競爭顯有落差，形成電信市場之參進障礙，最後則主張應將相關管制法令予以調整，以利市場競爭產生。

In the era of digital convergence, the framework of telecommunications regulation has passed 10 years since the liberalization of telecommunications market. The framework of telecommunications regulation remained as a sector-specific regulation framework, and it starts from the classification of telecommunications enterprises which is facilities-based or not. The market entry regulation stands for the key point of telecommunications regulation. This article firstly introduces the legal basis of telecommunications regulation, then analyses the market entry regulation of Telecommunications Act. Secondly, Ⅰ discussed the problems of the framework of market entry regulation which had enforced 10 years since 1996. Finally, Ⅰ reach the conclusion that in order to speed up the competition of telecommunications market, it should adjust the regulation of market entry.
