類產品（like product）之區分在國際貿易規範中對於分辨關稅與非關稅、義務與例外、進口與出口及內地與邊界等規範，具有相當的重要性。GATT1994第三條國民待遇原則因加入同類產品一詞，致使此一法律概念，在比較進口產品與國內產品時，成為認定國民待遇原則範圍之核心概念之一；但由於同類產品之不確定性，常常引發各會員國應遵守義務範圍之疑義，因此，為排除貿易自由化之障礙，並釐清貿易自由化與基於各國主權所生之國內管制權限間之界線，本文即從GATT1994第三條及GATT/WTO爭端解決案例的角度，來探討同類產品概念之解釋範圍。
