本文以國際組織的文件為本，從歷史釐清國際組織中「一個中國」問題的本質，探討國際組織對「一個中國問題」的法理爭議，由其中闡述中華民國與國際組織的關係，進而指出臺灣目前參加入國際組織的困境。本文認為，就國際法而言，政府的交替是不會損及國家的同一性或其繼續性，因此以國家名義簽署的條約，應由新政府加以繼承。1949年成立的中華人民共和國「政府」即是推翻舊國民黨政府成立的「新政府」，因此如果臺灣不釐清一個中國的問題本質，而逕以其他名義參與多邊條約或國際組織，不但無法彰顯或主張臺灣個別獨立主權，也同時喪失解讀為獨立主權國家之可能，形成臺灣在參與國際組織時的限制。
This essay takes the international organization's document as the basis to discuss the legal theory dispute of the 'One China question' of international organization and to clarify the essence of 'One China' from history. It will elaborate on the relations between The Republic of China and the international community concerning the constrains of Taiwan in joining international organizations. Speaking of International Law, the change of the government doesn't affect the identity or its continuation of the state. So the treaties signed with the name of the state should be inherited by the new government. The 'government' of The People's Republic of China established in 1949 is the 'new government' established after overthrowing the old Kuomintang government. If Taiwan doesn't clarify the essence of the one China question but use other names to join multilateral treaties and international organizations, this would not reveal or state the individual independent sovereignty of Taiwan, meanwhile Taiwan would lose the possibility of being acknowledged as an independent sovereign state, which will become a constraint that Taiwan will face when it joins international organizations.
