摘要 冷戰後智慧財產權﹙Intellectual property rights,簡稱IPR.﹚為當 代知識經濟之主要核心，先進國家亦藉此為獲取強權之利器，並加 速推動智慧財產權國際化，自「關稅暨貿易總協定」（General Agreement on Tariffs and Trade；簡稱 GATT﹚時代起即逐步將智慧 財產權納入國際公約保護，成立世界貿易組織（Word Trade Organization，簡稱WTO）時更同步訂定「爭端解決規則與程序瞭 解書」（ Understanding on Rules and Procedures Governing the Settlement of Dispute，通稱WTO 爭端解決機制，簡稱WTO/DSU） ，架構起一項多邊爭端解決機制以執行智慧財產權保護並確保國家 之競爭優勢。現今以美國為首之先進國家仍始終不間斷地推行其智 慧財產權保護政治策略，其影響力擴至全球。 本文内容先介述國際智慧財產權爭端解決與博奕理論之政治 策略應用，再分析GATT、APEC、WIPO 智慧財產權爭端解決之政 治策略特色，最後分析說明有關WTO 智慧財產權法律「與貿易有 關之智慧財產權協定」（Agreement On Trade-Related Aspect OnIntellectual Property Rights 簡稱：TRIPS）以及WTO/DSU 結構之相 關政治策略，綜衍出：當面對WTO 之智慧財產權爭端時，不但須 了解WTO/TRIPS、WTO/DSU 之形式法律規範，並應對該規範及操 作該規範之政治策略有所了解，俾可進一步擬定適當策略以避免淪 為博奕下之「輸家」，並進而尋求互利共贏之結果。
