The green shipping practice is to carry out the prevention of vessel pollution as well as the protection of marine environment, which has become a common issue for the international society and an important goal in marine policy. Under the concept of green shipping practice, this paper reviews the legal development of environmental salvage law in respect of the scheme of special compensation in the 1989 Salvage Convention. After examining the disputes in the application of Article J4 special compensation clause, this paper finds out the alternative solution is invoking the Special Compensation of P&I Clause (SCOPIC Clause) incorporated into an LOF contract, which completely replaces the questioned Article 14 in practice. Finally, this paper makes suggestions to the Authority f or the regulatory reform of the legal system of environmental salvage law in Taiwan, based on the relevant international conventions and legal practice.
