題名:美國勞資集體協商政策中經營管理權和工作權之界線:從協商議題之分類與法律效果觀察

     本文的主要目的,是企圖了解美國勞資集體協商中雇主經營管理權與勞工工作權之間界線的型態和特徵。為了達成此一目的,本文從美國集體協商法律政策中對協商議題所做的分類,以及所生的法律效果出發,並論述美國政府在經營管理權領域和工作權領域中,兩者「重疊區域」的政策立場。本研究發現,美國集體協商制度中經營管理權和工作權的界線相當模糊,在爭執的領域上,有逐漸擴大雇主經營管理權的自由程度,逐步限縮工作權中的勞動條件的保護程度。
