First of all, the study aimed to review the process of the amendment for “University Law” in 2005 in Taiwan, to compare the changes of the policy by analyzing the differences between the amendments in 2003 and 2005, and to examine the final legislative results. It was found that changes of policies from the Ministry of Education (MOE) were influenced by the Legislative Yuan, so the law could not achieve the expectation of MOE about certain higher education policies. Secondly, this study examined several controversial issues of higher education, such as the incorporation of public universities, the election of president in universities, the procedure for decision-making in universi-ties, and the restructuringt of academic and administrative organizations, by comparing with Japanese universities that were recently incorporated. Finally, the study argued that MOE should play a leading role in strategy-managing of higher education and take the responsibility of decision-making. In order to fulfill the political responsibility for the general public, the intention of Legislative Yuan to change the policy made by MOE should be based on concrete public opinions or reasons.
