Both an 'act' and 'failure to act' (omission) can be crimes. Omission is defined as the failure to act when you know you have a duty to act and have the ability to act. The studies on criminal judgments to omission negligence in nursing behaviors have usually been neglected. This article aims to explore the negative crime of nursing behaviors and analyses in what condition nurses become negative crime. It is expected that this article will assist nurses in understanding the negative crime and relevant legal responsibility.
