論文提要內容: 本論文共一冊,計333,790 字,分七章二十八節。本論文之研究對象為北美自由貿易區之勞動事務之制度,其主要包括北美自由貿易協定中之十二章「跨國界服務業貿易」、十六章「商業人士暫准進入」及北美勞動合作協定之實證規範,其十二章之跨國界服務業貿易與十六章之商業人士暫准進入,皆是在規範專門技術勞工之跨國執行勞務之問題。其涉及國民待遇原則,因而與專技勞工之就業問題息息相關。而北美勞動合作協定雖以勞動合作為名,其主要為透過與經貿規範掛勾之國際勞動權益標準之設定與爭端處理之制度之建立。北美勞動合作協定建立了跨國勞動法執行之監視制度。
Abstract
This Dissertation is a work of legal research on the trade-related labor issues of NAFTA. It includes the study on the cross-border service provision and the basic labor right protection under international agreements.
Chapter 12 of NAFTA provides an inter-governmental mechanism for cross-border service providers to perform their foreign business without being unfairly treated. National treatment should be granted to foreign service providers by host country. Consequently, this international arrangement is highly significant in creating job opportunities for the professionals of North American countries.
North American Agreement for Labor Cooperation (“NAALC”) is a supplement agreement to NAFTA, which imposes international obligations on contracting parties to provide labor right protection for their worker in order to promote the fundamental labor rights under the structure of free trade. A dispute resolution mechanism is also provided under the agreement. Pursuant to NAALC, a country may monitor the labor practice of the other country.
