題名:建立二階段技術定位模式-以商業方法專利分析為例

網際網路時代的來臨,對企業經營產生了巨大的影響,藉由網際網路環境及其特性所創造出新的商業方法,更是企業獲利的最佳武器。自從美國專利商標局頒佈了商業方法專利白皮書後,相關企業無不競相申請商業方法專利,期能在這一塊新的戰場中取得有利的競爭位置。然而,商業方法技術領域具有高度的跨產業特性,包括競爭者來自何方、擁有何種能力、以及企業自己身處何種位置,都是不容易察覺的。因此,必須建立一套有效的技術定位模式,來瞭解商業方法技術特性,進而擬訂企業之技術策略。
專利,是企業技術的表徵。透過企業所擁有的專利組合,可以瞭解企業主要之技術能力類別;而透過企業專利的引證關係,可以發現企業對外技術依賴之關聯。同時進行上述兩種分析,能夠歸納出技術類型相近、且技術依賴性高之群組。然而,總體的量化分析仍不足以解釋的群組之技術特性,以及群組內的技術網絡關係。因此,必須配合個體內容分析,以充份瞭解群組之技術內涵。
本論文兼顧總體與個體不同角度,以專利分析方法建立二階段之技術定位模式,且以商業方法技術領域進行實證。研究貢獻可歸納為下列五點:1.發展一套包含總體量化與個體內容分析方法之整合式二階段技術定位模式,可作為未來探討其他特定領域技術定位之依循架構。2.針對商業方法、電腦軟體、電子商務、與商業模式之關係及差異深入剖析,對於日後進行相關議題研究時,能明確清楚,不致混淆。3. 在技術資源之策略觀點上,本研究兼顧內部資源基礎與外在資源依賴二種觀點,採用專利組合與專利引證二種資料,同時進行企業之技術定位分析。4. 本研究在個體內容分析上,選擇目標群組內的代表性專利,透過專利內容分析及其引證網絡關係,瞭解該群組之技術特性,以彌補總體量化分析無法解釋之現象。5. 在商業方法技術發展上,歸納出「資料保護群」、「作業研究群」、「財務群」、及「郵資計量」等四個群組,並分別描述出每個群組之技術特性。本論文最後提出四項研究建議,包括相互引證矩陣之修正、納入企業之產品與服務進行分析、從縱貫面探討商業方法技術之演進、以及擬訂群組各別企業之技術策略等,可作為後續研究之參考方向。
With the Internet now widespread, business methods based on Internet technology have become a critical factor in the success of an enterprise. As with enterprises in other high-tech industries, every company in the Internet industry must develop a patent strategy according to its core competencies to establish competitive advantages. But it is difficult for enterprise to finding competitors where come from, what capabilities are there, and where positions locate I, because the technologies of Internet are highly cross-industries. Therefore, this thesis will establish an effective model for business methods technological position, and try to formulate the technological strategy.
Patent is an indicator for technology. Using the patent portfolio, we can understand the capabilities of the firm, and using the patent citation of firms, we can find the relationship of the dependency of firms. These two methods are useful to grouping the enterprises, but it cannot know the characteristics of technological groups still. So, the thesis combines the macro quantity analysis and micro content analysis of patents, expect to solve the problem above.
The contributions of this study are: 1. Developing a two stages model for technological position, and use business method technology field to validation. 2. Clarifying the means of business method, computer software, e-commerce, and business model. 3. About the strategy approach, not only use inside resource-based, but also use outside resource-dependent. 4. Choosing the target group, analyzing the patent content and citation network relationship. 5. In business method technology field, can be divided to four groups: data protect, operation research, finance, and postage metering. Finally, there are four suggestions of future studies: modifying the citation matrix, combine products and service of firms into analysis, from the longitudinal analysis to research the evolution of business method technologies, and formulate the technological strategy of the firm of objective group.
