本文以聯合國針對國家人權機構所建構之理想及準則為基礎，分析愛爾蘭人權委員會，並且著重於歷史、組織及職權等三個面向。本文認為愛爾蘭人權委員會值得讚許之處包括在組織面向其規定任命委員時應兩性平衡，委員亦相當具有多元性及代表性，委員之任期及解職要件明確。在職權面向，人權委員會有廣泛之職權，同時已妥適扮演促進者及橋樑之角色。但是本文亦認為有些部分是愛爾蘭人權委員會可改進之處，例如在組織架構上，人權委員會與行政部門有較密切之聯繫，行政部門任命所有委員，無委員之豁免權規範，預算不足，職員不夠，都影響人權委員會之運作。而在職權上，恐怕難以認定人權委員會已善盡保護者之角色。
This paper examines the Irish Human Rights Commission in light of the ideas and principles established by the United Nations, and focuses on three issues: legal basis, structure and functions.This paper finds some positive characters of Irish Human Rights Commission. Regarding its structure members of the Commission are gender-balanced and plural. Regulations of commissioners' terms and conditions are clear. In the field of function the Commission has broad mandates and has played good roles as promoter and bridge.However, this paper also argued that there are still some fields can be improved. Concerning its structure those include the Commission has too close linkage with administrative branch; the government appoints all its members; there is no rule governing members' amnesty; the Commission does not have sufficient budget and staffs. All these have damaged the Commission's functions. In the field of function it is difficult to say that the Commission has become a real protector.
