刑事制裁制度之目的主要在於應報、威嚇、隔離與矯正，矯正之最終理想則在 於使犯罪者能夠復歸於社會，自我更生。惟，我國在近年所採行之「寬嚴併進的刑 事政策」之下，基於嚴格之刑事政策，在未來所引發的長期監禁與收容人擁擠問 題，已是不可避免的趨勢；在寬容之刑事政策下，所採取的轉向或替代措施，特別 是導入社區處遇方式以替代刑罰之運用，雖然短時間內可以有效緩和監所擁擠問 題，但是否可有效達到防止再犯與促其再社會化之目的，頗值探究。而對於近年 來，社區處遇方式在我國刑罰制度上運用之成效，亦值探討。

The mainly purposes of the penal system are vengeance, menace, isolation and correction. The final purpose of the corrections is to make the criminal return to the society. In these years, the criminal policy advanced together with hard and soft was adopt in Taiwan. By the hard criminal policy, the problem of jailcrowded is inevitable. And by the soft criminal policy, even the measure of diversion and substitution of the penal and the community corrections in the penal system currently in force was adopted, the jail-crowded problem may be moderated, but it is doubted that can it be able to make the criminal corrected and to make them return to the society. The achievement of the adopting of community corrections in the penal system in force will be examined finally.
