題名:替代性糾紛解決機制運用於都市更新私權爭議之研究

都市更新相關法令繁雜且程序冗長,推動過程中充滿著不可預期和不確定性,實施者較地主掌握更多資訊,多數都市更新戶不瞭解都市更新、營建、估價等相關法令,不熟悉都市更新作業程序,亦不清楚建造成本、財務模擬試算、權利變換分配模式,缺乏都市更新相關專業能力,與業者間存在許多資訊不對稱的問題。如此一來將會延長協商時間及增加交易成本。此外,都市更新參與者與實施者之間缺乏有效的溝通、協調與討論的平台,雙方互不信任,導致都市更新推動更加困難。替代性糾紛解決機制或許可以成為都市更新私權爭議解決之方式之一。本文以美國奧瑞岡州「土地利用規劃」替代性糾紛解決之模式,以及日本公害等替代性糾紛解決之模式進行文獻分析,並檢討我國目前之不動產相關之爭議解決法制,再進一步分析都市更新現況與執行之糾紛與爭議所在,提出都市更新糾紛解決機制,以達調解實施者、都市更新參與者爭端解決之目的。
The laws and regulations of Urban renewal are very complicated, the process to promote urban renewal is lengthy, full of unexpected and uncertainty. Urban Renewal Developers hold more information than the Landowners. Most Urban Renewal households do not understand the regulations of urban renewal, construction and valuation. The landlord does not know the administrative procedure, the cost of the buildings construction, financial simulation spreadsheets, rights transformation distribution models etc. The landlords were short of urban renewal professional competence, so that it occurred information asymmetry between the urban renewal participants and developers. Thus, information asymmetry will extend consultation time, and increase transaction costs. In addition, it lack an effective communication, coordination and discussion urban renewal platform between participants and developers. participants and developers Do not trust each other, it resulted in promoting urban renewal hardly. Alternative dispute resolution mechanisms may be able to become one of the ways to resolve the dispute of urban renewal. This paper analyzed the Oregon "land use planning" alternative dispute resolution mode of United States, and pollution alternative dispute resolution mode of Japan. Then, this paper reviewed the legal immovable disputes resolutions in Taiwan, and analyzed the disputes of urban renewal status and implementation. Finally, this paper proposed the urban renewal dispute Resolution mechanism, This paper aimed to achieve the purpose to Resolve the Disputes between developers and urban renewal participants.
