<正>在西方社會大眾和為數不少的學者眼里,1215年英國《大憲章》的主要價值是所謂"自由"理念的張揚。然而,《大憲章》闡述的究竟是什么"自由"?這個問題其實大有可議之處。首先需要指出,由於現有《大憲章》中譯本中屢次出現的"自由"一詞是翻譯而來(而且主要是基於英文譯本的翻譯),因而這個問題在一定意義上是一個中文世界特有的問題。問題之源是中文"自由"被用來對譯了《大憲章》拉丁文原文中包括libertas在內的多個術語语，從而造成了表達和理解上的混亂。
