　　　　　二OOO年六月廿七日，法國總統席哈克在德國下議院發表演說，倡議考慮制定「歐洲憲法」，正式揭各界關於「歐洲憲法」的辯論，迄今未歇。二OO一年十二月十五日，歐盟高峰會發表「歐洲聯盟的未來」聲明，表示將「歐盟在未來是否需要制定一部憲法」列入翌年三月一日起召開的「歐盟未來辯論大會」討論議題中，不僅是十七世紀以來呼籲制定「全歐憲法」理想的實踐，更呼應了歐盟五十餘年來建立「憲政秩序」已卓然有成的事實。然而，儘管以歐盟和歐體為核心的「泛歐憲政秩序」已儼然成形，且與當前關於制定「歐洲憲法」的倡議相互呼應，但是歐盟不可能通過修約或制憲，建造「歐洲聯邦」，而會依循現有趨勢，致力於上述「憲政秩序」的法典化，用以回應要求建立歐洲聯邦的壓力，同時化解關於統合路線的爭議。針對上述發展，以「憲政主權」概念為核心的「歷史機制論」遠較新功能途徑具有解釋力。依據這個理論，新的協議在短期內將可抵擋聯邦論的壓力，但長期看來，卻有可能反而加速了歐洲聯邦的建構。

　　　　　Since French President Jacques Chirac called for the creation of a European Constitution on June 27, 2000, a hot debate over the adoption of a European Constitution has developed at the European convention and all over Europe. Though this idea echoes well with the founding fathers of the EU, who never ceased dreaming of a European federation, the project of writing a constitution does not aim to build a federation as expected by the federalists. On the contrary, it was presented with the intention of resisting the federalist advance. As a result, it will not lead to the adoption of a new constitution, but only the codification of the existing pan European constitutional order based on EU/EC governance. This development can be well explained by historical institutionalism, according to which such a codification will relax the pressure for a European Federation in the short term, but accelerate its creation in the long run.
