本文之目的，是要透過國際上對外籍勞工人權保障所採取之各項作為，來對歐洲聯盟保障這些勞工基本人權之相關規範及實施情形，做一全面之比較分析及回顧探討，同時，並說明歐洲聯盟在這方面之努力，對我國外勞政策所能提供之啟示。除序言及結語外，全文共分四個部分：首先，將探討國際上建構保障外籍勞工人權勞動基準之發展趨勢。其次，將分析歐洲聯盟引進外籍勞工之發展沿革及未來走向。再者，將對歐洲聯盟保障外籍勞工基本人權之相關法制，做一全面性之檢視。最後，則是將歐洲聯盟保障外籍勞工基本人權之具體實踐，與其他國際組織或經濟體所訂定之相關公約或協定之內容，做一綜合比較，以評定其良窳，並檢視歐盟之相關制度，在保障外籍勞工基本人權做法上，可提供我國參考省思之處。

This paper gives a comprehensive review of the European Union's safeguarding of human rights of foreign workers with respect to other international labor standards. It also examines the actual contents of this protection compared with related standards proposed by other international organizations. Furthermore, it discusses whether these efforts can be applied to Taiwan. In addition to the introductory and concluding remarks, this paper is divided into four sections. Section One provides an overview of worldwide developments of mechanisms in protecting foreign workers such as efforts made by the International Labor Organization, United Nations, and the NAFTA. Section Two describes the political and economic background of the EU’s recruitment of foreign workers, as well as past practices and fu-ture developments. Section Three assesses the EU's legal framework concerning the protection of fundamental human rights for foreign workers. Section Four compares the EU's practices with related in-ternational labor standards and analyzes their merits and shortcomings. Finally, it also discusses whether the EU’s regime can be applied to Taiwan in its endeavor to protect the fundamental human rights of its foreign workers.
