博弈論描述一個或一束制度下人們的行動決策,以及不同環境中這些行動導致相應的社會結果。把法庭推理與司法調整嵌入社會博弈之中,結合博弈論解理論的方法,原則上可以刻畫法律通過不同的激勵安排能夠實現的行為模式,從而刻畫法律能實現的目標。法律與其他社會規範共同為組成社會的所有行為主體提供了制度激勵,立法者任何合乎社會正義理念的目標,只有作為他們在社會博弈中的均衡行為的結果,才能得到合理實施。

Game theory describes people’s action decisions under one system or a group of systems, and the results brought about by their actions in different environments. Embedding the reasoning of law courts and judicial modifications in a social game and combining it with the methodology of game theory enable us to depict in principle the behavioral model the law can achieve through various incentive arrangements, and thus portray the goals that it can attain. Together with other social norms, the law provides institutional incentives for all the behavioral agents that make up society. Those objectives of lawmakers which are consistent with the concept of social justice can be reasonably implemented only when they are viewed as the results of equilibrium behavior in a social game.
