2001年九一一事件後，美英兩國相繼制定防恐法案，包括美國頒布的「軍事命令：反恐戰爭中對特定非公民的拘留、待遇和審判」和「2001年提供攔截和阻止恐怖主義所需的適當工具，目的在團結和強化美國人」以及英國通過的「2001年反制恐怖主義、犯罪與安全法」。然而，當各國際組織及國家採取措施打擊恐怖主義的同時，亦有可能使反恐成為藉口，進而傷害各種人權，而其結果是以反恐之名而行危害人權之實。因此，如何兼顧反恐與人權已成為國際人權界近幾年來非常關心之議題，也是必需確實實踐之理念，否則當安全高度凌駕人權之上，將造成人權之極大傷害。
After the 911 terrorist attack in 2001, America and England legislated anti-terrorism acts one after another, including 'Military Order: Detention, Treatment, and trial of Certain Non-Citizens in the War Against Terrorism' and 'Uniting and Strengthening American by Providing appropriate Tools Required to Intercept and Obstruct Terrorism of 2001' of America and 'the Anti-Terrorism, Crime and Security Act 2001' of England. However meanwhile international organizations and States adapt measures to counter terrorism, anti-terrorism could also be an excuse to harm all kinds of human right. The result might actually harm human right in the name of anti-terrorism. So it's been a subject of concern for the international human right community in recent years about how to consider both anti-terrorism and human rights. It's also the idea that we should truly realize that it would be extreme harmful for human rights if security is given priority over human rights.
