題名:國際關係建構主義理論主權觀之透視:經貿全球化、人道干預與反恐怖主義

傳統(威斯特伐利亞)主權理論在當代國際關係的具體實踐呈現於《聯合國憲章》及其發展而來的相關原則,以及國際關係實務所出現的相關議題之中。尤其是在全球化的時代,在當前經貿全球化、人道干預與國際恐怖主義活動的背景下,對於世界貿易組織、2003年伊拉克戰爭與關達納摩灣基地拘禁恐怖份子事件,傳統的國家主權理論受到衝擊與影響,其對國家主權在哪些方面受到弱化?在哪些方面得到強化?為此,實有需要重新檢視國際關係主權理論,以理解國家主權原則的演變,以及反思其理論和實務的價值。建構主義是國際關係新興的理論,並成為主要理論之一,是否能藉由建構主義作為檢視國際關係主權理論的基準,是值得研究的議題,尤其是其認為國家主權是行為主體與(國際)結構相互建構的社會建構體(social construction),此相互建構的動態過程更是符合國家主權的歷史演進的變遷過程,即使仍無法取代現實主義成為國際關係的主流理論,但建構主義能 提出另類的思考觀點,增加國際關係理論的多元性。
本研究的目的即是意圖從《聯合國憲章》的國家主權觀點著手,探索當代(西方)國家主權概念的緣起與主權原則的國際規範意涵,進而探討在當前世界貿易組織的經貿自由化,美國2003年軍事干預伊拉克,以及美國大法官會議對基地組織恐怖份子拘禁關達納摩灣基地的判例,所呈現經貿全球化、人道干預與恐怖主義活動對傳統國家主權原則的挑戰,以及企圖藉由當前國際關係規範取向建構主義理論觀點反思傳統的國家主權理論,進而指出學者應該重新思考國家主權原則(理論)的意義,俾能提出新的國家主權理論思維與提供國際實務的參考。
In the contemporary international relations, traditional (Westphalian) sovereignty theories are concretely realized in the United Nations Charter and its related principles as well as related issues appeared in the international relations practices. Particularly, in a globalization era, the current economic globalization, humanitarian intervention and international terrorism activities as the background, how did the World Trade Organization, 2003 Iraq War and Guantánamo Bay detainee issues brought out the impacts and influences on the traditional sovereignty theory? Which aspects have been weakening by it? And, which aspects have been strengthening by it? Therefore, It is necessary to review the sovereignty theories in International Relations Theory to understand the evolution of state sovereignty theories, and to reflex their values in theory and practice. Constructivism is a emerging theory and a main theory in International Relations Theory, It is noteworthy whether it could be a criterion to review the sovereignty theories in the International Relations Theory? While it took the sovereignty as a social construction was constructed by agents and structures. The dynamic process of the social construction indeed fit in with the historical evolution of state sovereignty, although it still can not displace realisms, constructivism can provide an alternative thinking to increase the diversity of International Relations Theory.
This dissertation tries to explore the origin of contemporary (Western) state sovereignty concepts and the implications of sovereignty principles as international norms, as well as discuss the economic globalization of the World Trade Organization, U.S. 2003 militarily intervened Iraq, and U.S. Supreme Court decisions regarding Guantánamo Bay detainee that involved international terror attack, all that have show the economic globalization, humanitarian intervention and terrorist activities have brought out the challenges to the traditional state sovereignty theories, with the norms-oriented constructivism to reflect that traditional sovereignty theories have said to us, and then make a point that scholars should rethinking the meanings of state sovereignty theories, to provide new thinking of state sovereignty and practical suggestions to international relations practice.
