後ECFA 時代，海洋事務是兩岸可以擴大並且深化經濟合作領域 的重要項目，然而海洋事務繁瑣，究竟雙方可從何處著手？本文主張， 雙方最有可能擴大和深化合作者，首要在於有效開發和養護海洋生物 與資源，其次是和平利用國際海上要道，再其次是就管轄權（而非主 權）公平劃分海域疆界。至於和平解決海洋爭端方面，司法解決勢必 不可得，最終只能看是權力或是力量作用的結果。

In the post-ECFA era, the marine affairs are important projects that Taiwan and Mainland China can expand and deepen the field of economic cooperation. But the marine affairs are tedious, where should both sides to start with? This article argues that both sides are most likely to expand their cooperation in the management of marine natural resources primarily, peaceful uses of international watercourses secondly, fair division of maritime jurisdiction and boundaries thirdly, and peaceful settlement of marine dispute lastly.
