本文之主旨乃在探討冷戰結束後，歐洲聯盟於準備接納中、東歐前共產國家入會之背景下，爲了鞏固其新興之民主體制及保障人權，而逐步在條約中建立起預防與制裁的機制，以便一旦會員國發生民主倒退或是戕害人權之跡象或狀況時，能夠有所因應和處置。爲循序鋪陳分析，本文沿著歐賬發展的進程，先瞭解歐賬建立保障人權與民主機制的緣由，接著探究奧地利事件所帶出制度設計不完善的缺失，以及後來召開政府間會議時所做之調整；繼而針對歐賬條約第七條所列之程序與內容，進行詳細的探討，俾據以評估此預防與制裁機制之可能成效。作者認爲，儘管條約規範仍有若干法律效果上的缺失，然而有了這一整套監督、預防和制裁的程序，不僅有助於鞏固會員國民主和法治之發展，對於歐賬公民的人權與基本自由，也多加了一層保障。

This essay explores the evolution of preventive and sanctions mechanisms of the European Union against a background of eastern enlargement. The instruments are initially established in case of a serious breach by a Member State of the principles on which the EU is founded. At the outset, the article will briefly review the EU's mechanism and institutional structure which protect, inter alia, democracy, human rights and rule of law. Next it will describe the "Austrian case" happened in 2000 as well as its influences over Treay modifications and innovations. Finally, the article exams the provisions set out in the Article 7 of the Treaty of the European Union and evaluates the revised version of the preventive and sanctions mechanisms. The author concludes by noting that in spite of some minor deficiencies, the procedures of monitoring, prevention and sanctions do contribute to the democratic consolidation and human rights protection in Member States.
