性侵者登記及公告制度源起於美國梅根法案，其要求執法機構對釋放後之性侵者執行「警局登記」與「社區公告」之處遇，本意是提高民眾社會防衛，卻引發了許多負面及其他非預期效應。台灣每在有重大性侵害案件發生時，效仿梅根法案的呼聲就會提高，但究竟何為適當之登記及公告制度，值得思量。本文以政策分析法，從梅根法案的源起談起，連結近10年發展趨勢、實證研究與台灣現行之登記及公告制度。對比之下可看出台灣的制度較為保守，但也未有如美國之負面影響。本文最後嘗試提出一個能增加社會防衛且減少社會敵意的較佳方案而提出公告各地之中高及高再犯危險之性侵者人數，並搭配嚴密之警察訪查與社區治療方案，以不背離該法案增加社會防衛之本意。

The sex offender registration and notification program (also called Megan’s Law) was derided from America. The program requires the released sex offenders should register themselves to the police periodically and the community people should be notified if the sex offender live around them. The original idea of this program was to keep social defense, but the unexpective effect showed continuously. Some advocates in Taiwan promoted the Megan’s Law in America, once the horrible sex murders happened. The article was to reassess the law and suggest the better version. We used policy analysis to explore the origin of the law, the tendency in the past 10 years, and the empirical study findings. Compared to the Megan’s Law, the sex offender registration and notification program in Taiwan is relatively conservative, but it avoids the negative effects like America had. Finally, the announcement for the numbers of the local moderate-high and high risk sex offenders in community is suggested to be the better version of notification, based on the idea of increasing the social defense and decreasing the social hostility. The prior suggestion should also accompany with higher density of policesurveillance and community treatment to make community defense working better.
