　　　　　雖然強姦罪於民國八十八年三月三十日經立法院三讀通過修正為強制性交罪，強姦罪從妨害風化罪章節裡提出，另行設置妨害性自主罪，強制性交罪的被害客體不再只限制女性，男性也可以成為被害的對象，但是未來強制性交罪的被害人仍然會以女性居多。台灣地區近二十年來強姦犯罪呈現逐漸增長的趨勢，然而近四年來（民國八十四年至八十七年）卻有大幅上升的現象。為了對強姦犯罪問題以及強姦被害人創傷症後群後有更深一層的認識，首先，本文從社會文化的觀點來探討強姦犯罪的原因，分別從性別歧視、情色傳媒、暴力文化、和社會瓦解等理論來分析強姦犯罪的原因；其次，介紹強姦被害人在生理和心理方面的創傷症；最後，再探討刑事司法體系要如何加強保護強姦被害人的對策。
