摘 要
近年來,犯罪暴力化及惡質化幾乎成為主流趨勢。而其中,性侵害殺人案件由於兼有性侵害及殺人之犯罪特質,對於女性等弱勢族群的人身安全更造成嚴重的威脅,隨之引發的社會震撼亦極為深遠。
本論文為瞭解本土性侵害殺人案件之特性,俾利提供偵查及後續研究參考,篩選及蒐集台灣地區最近十年內性侵害殺人案件共四十二件進行質化及量化研究。在量化方面主要以內容分析法針對資料進行分析,再以敘述統計分析及關聯性分析等統計方式詮釋產生數據。在質化分析方面主要針對十二個性侵害殺人犯罪人進行心理測驗分析及深層訪談,以解釋犯罪人之犯罪心理及行為特性。本研究結果發現:
一、 性侵害殺人犯罪人、被害人、犯罪情境、犯案手法及犯罪現場特徵皆有其特異及關聯之處,犯罪預防體系可針對犯罪高危險群及犯罪情境進行預防,偵查人員也可針對現場特徵及犯案手法推測可能之犯罪者。
二、 性侵害殺人與殺人案件及性侵害案件,在發生場所、犯罪工具、犯罪人職業、年齡及被害人諸項特性皆呈現顯著差異結果。同時,在發生時間、犯罪工具及被害人的諸項特性與殺人犯罪較類似,在發生場所及犯罪人的諸項特性則較與性侵害犯罪較類似。
三、 在三組連續性侵害殺人案件中,同一犯罪人犯下不同案件之各項特性總平均相似度高達78.57﹪,顯示連續性侵害殺人犯罪具有相當高之慣性。
四、 根據心理測驗及訪談結果,可將性侵害殺人犯罪人區分為「中間型」、「有控制能力型」及「低控制能力型」等三種,其在「背景資料及人格特質」、「犯罪手法」、「犯罪現場特徵」亦均有其族群特性。
最後,本論文僅提供下列建議,供實務機關作為研訂防治性侵害殺人犯罪刑事政策制定參考:(1)建立性侵害殺人犯罪預警制度、(2)建構偏差心理及精神醫療體系、(3)宣導性侵害殺人犯罪之正確預防觀念、(4)加強偏遠地區安全防護工作、(5)建立性侵害殺人犯罪防制策略、(6)強化現場勘驗及科學鑑識、(7)性侵害殺人犯罪偵查建議事項、(8)建構電腦化犯罪連結資訊系統、(9)建立偵查、現場及心理剖繪三角偵查架構。
