An adequate amount of sunlight must be maintained in our living environment. Recent studies involving sunlight right have emphasized a technological solution. However, the law of right analysis has received only limited attention. In fact, studies involving sunlight right must be matched by environmental right, tort approach and decision-making priority processes. This study differs from the "traditional environmental right theory". This study aims primarily at reviewing and criticizing tort approach for the reference of environmental decision-making and architectural management analysts. This study presents an overall framework of sunlight right analysis. Also briefly described is the feasibility of applying a hierarchical system of law position in environmental impact assessment. The contents of this paper includes environmental right analysis, tort approach, sunlight right context and its application. Results presented herein can hopefully improve the sunlight condition and environmental quality in high-rise building areas. Moreover, recognition of sunlight right and its control direction in the future are discussed as well.
