強姦行為之心理歷程的動態分析
摘要
近年來強姦犯罪行為受到社會重視,但國內有關強姦犯罪行為的實徵研究卻不多,而且迄今並未建立一套系統性的理論。有鑑及此,本論文特從事強姦犯罪行為心理歷程的探討,並建構本土化的有關理論。
首先,研究者進入監獄,訪談強姦罪受刑人,從受訪者的敘說當中,蒐集有關強姦犯罪者心理與行為的資料;在資料蒐集告一段落後,進行資料的整理與組織,形成有系統的知識,最後建構本論文的理論模型──強姦行為之心理歷程的動態分析。該項理論從社會文化層次、個人心理層次、情境層次與個人行為層次等四個面向,分析強姦行為形成的原因與強姦者從事犯行的心理歷程。
在社會文化層次的因素上,由歷史文獻的回顧、文字詞語的分析,以及相關理論的探討,可得知華人社會是以「男性繼嗣」、「男性為尊」的父權體制社會。在父權體制社會的文化背景下,男性強姦女性的行為得到滋生,而出現社會上大多數是男性強姦女性的現象。
其次,在個人心理層次的因素上,當男性自覺未能達到社會期許時,會產生挫折、自卑與孤單等情緒,此等情緒在無法排解的情況下,進而衍生出補償或尋求肯定的動機。當居於社會優勢地位的男性,認為自己被(通常是女性)欺騙、不公平對待、尊嚴遭羞辱、權益受侵犯時,常會產生抑鬱、懷恨與不滿的情緒,此等情緒衍生出想要報復與發洩怨恨的動機。當男性認知或想像到強姦行為所帶來的刺激感與新鮮感,則會產生好奇與興奮的情緒,導致追求刺激的動機。尋求肯定、發洩怨恨與追求刺激,是強姦者從事犯行的三項主要動機。此等動機雖有多種管道可予滿足,然而強姦犯卻選擇以強姦行為來因應或滿足這些需求,與其經驗以及學習途徑有關;亦即,特殊的經驗(例如,本身曾被性侵害、目擊或耳聞親友被性侵害等)與學習途徑(例如,從同儕朋友、報章雜誌或色情影片等),促使強姦者發展出強姦行為的意圖。具有強姦行為的意圖到真正施行強姦行為,人格因素尚扮演著重要的角色;衝動性高者、喜好追求刺激與缺乏同理心者,較易施行強姦行為。
再其次,在情境層次的因素上,強姦者會考慮當時情境的安全性、隱密性與熟悉性,並進行風險評估(例如,是否會被逮捕、刑罰是否嚴重),以此決定是否施行強姦行為;若是察覺情境並不安全,有可能被逮捕,則不會輕啟行動。當時的身心狀態(例如,是否飲酒、用藥、觀看色情影刊、遭逢重大壓力等),亦會影響個人對情境的知覺以及風險的評估。
最後,在個人行為層次的因素上,施行強姦行為取決於個人是否具有強姦意圖、人格特質與當時情境這三項因素間的交互作用。強姦行為再犯率相當高,與強姦行為的效果及強姦者對其行為的合理化有關;愈能從強姦行為獲得滿足以及對其強姦行為進行合理化者,愈易再犯。
本論文分別以質化的研究方法(深入訪談、投射式深入訪談)與量化的研究方法(問卷調查法、投射式問卷調查法)等四項研究,來檢證理論,結果顯示理論大致得到支持。本論文提出研究成果在強姦行為之診療、防制與偵察上的意涵。在未來的研究方向上,則提出家庭內的問題對強姦行為形成的影響、與異性相處的經驗對強姦行為形成的影響、社會對男性期許的影響、認知、情感與性興奮對強姦行為形成的影響等幾項值得進一步探討的議題。
