This paper aims to examine the necessity for Culture and Education Rights to be brought into the Constitution of Republic of China and the content with which the amendment should be taken into consideration. First of all, the meaning and the scope of Culture and Education Rights will be defined and then the regulations of Culture and Education Rights in the International Human Rights will be studied. At the same time, the development of Culture and Education Rights in the Constitutions of different nations will be analyzed. Furthermore, I will refer to the relevant regulations of Culture and Education Right which are newly established in the Constitutions of several nations since 1990's and make a comparison in order to analyze the differences among them, survey the development trend in Culture and Education Rights, and review the relevant regulations and problems of Culture and Education Rights in the current Constitution of Republic of China. Finally, based on the results of above analyses and comparisons, some recommendations will be made in terms of the meaning for Culture and Education Rights to be brought into the New Constitution and the content to be considered accordingly for the sake of reference toward future amendment or establishment of the Constitution.
