歐洲整合由於涉及到諸多會員國法律體系，爲避免歐洲共同體法與各會員國之內國法產生不一致之情形，故創始條約就歐洲共同體法與會員國之內國法設有一調和制度，即初步裁決制度。倘若會員國法與歐洲共同體法有不相一致之情形，會員國法院或法庭則依據歐洲共同體條約第234條向歐洲共同體法院提請裁決。本文謹就此一制度做一概要之說明與分析。
