　　　　　「明恥整合理論」(the Theory of Reintegrative Shaming)自一九八九年由澳洲犯罪學家 John Braithwaite 提出以來，就一直受到犯罪學界相當的重視。本篇文章係 Braithwaite 於一九九五年所發表的文章，其內容的第一部份乃以精粹的筆法及清晰的觀念來介紹明恥整合理論，文中不僅詳述羞恥 (shaming) 的意涵及種類，更論述了明恥文化乃為有效抗制犯罪之關鍵的觀念。在本文的第二部份中，作者介紹了刑事司法共和理論 (the Republican Theory of Criminal Justice) 的主要意涵，認為刑事政策的目的不僅不應限制個人的「自主」 (dominion)，反而應該盡可能地使個人享有自主; 並以此觀念來判斷羞恥作為的適當性，進而以其為指導及規範正確羞恥作為的準據。基於上述解釋犯罪的理論以及規範的理論，作者最後提出了抗制犯罪的政策。在宏觀的政策面上，作者主張運用社會運動的力量，對應犯罪化而未被犯罪化的行為予以犯罪化; 另在微觀的政策面上，作者認為源自紐西蘭毛利人的社區責任會議，可以作為多元文化社會中凝聚道德力量以及降低犯罪的有效機制。在本文的結論中，作者強調其所主張的理論及政策非常適合於多元文化的社會 (如美國 )。
