　　　　　中央政府近日與臺北市政府間有關里長延選爭議之關鍵，在於地方制度法第八十三條第一項所謂特殊事故之意涵，雙方見解不一，並因造行行政院撤銷市府延選決定，及市府聲請釋之後續發展。其中復牽涉自治監督之根本原則問題。本文經比較分析後，主張司法院釋字第四九九號解釋未必即可當然套用至本案，內政部之相關解釋亦僅具參考之價值，無法拘束臺北市政府，而行政院使用行政監督之方式更不足取。
　　　　　Whether a city government may delay8 the local election because of the adjustment of administrative districts within the city or it has to follow the instruction from the above to hold election as scheduled? This dispute directly relates to the scope of local self-government as well as the methods and limits of supervision. The attitude of the central government is subject to a full examination in this case.
