本論文的主題在於考察當代義大利哲學家阿岡本(Giorgio Agamben)的例外狀態(state of exception)理論思想。阿岡本關於例外狀態理論的思想系譜脈絡主要是承續與詮釋史密特(Carl Schmitt)與班雅明(Walter Benjamin)的思想論戰發展而來(依阿岡本所言是一場隱密的對話)。而且,阿岡本除了深化史密特的主權與例外狀態的思想使其具有分析主權政治結構的認識論基礎之外,他關於例外狀態的思想建構最主要理論意圖便是在於建構一種班雅明意義上的彌賽亞主義式的例外狀態思想,並以後者來對反於前者。因此,例外狀態在阿岡本的重構下,已經不再只侷限於傳統意義上的憲政司法問題而已,而是深化為一個司法─政治─哲學─神學的本體論問題。另外,阿岡本對於例外狀態的思想,就政治社會理論的層次來看,其最具創見與系統性的理論成果便是他的生命政治(bio-politics)理論建構。阿岡本以此來試圖修改傅柯(Michel Foucault)的生命政治理論,認為每個生活在主權例外狀態之下的生命都是一種裸命(bare-life)。就政治社會思想史而言,阿岡本可以說是第一個將「例外狀態」此一術語從傳統的法學術語擴大為整個社會科學乃至哲學思考對象的理論家。而從當代政治的脈絡來看,阿岡本對例外狀態的思想特色在於:(與史密特不同)他把例外狀態的「優位性」提高到主權者之上(在認識論上或是在本體論上阿岡本都認為例外狀態比主權者更具基礎性),並把例外狀態與主權的關聯予以拆除,從而賦予例外狀態具有終結傳統主權政治的革命性,以及開啟來臨中/將來的(the coming)政治之關鍵「門閥」(threshold)地位。最後,阿岡本並以例外狀態的發生來建立一種恢復或保持人類的潛能性(potentiality/impotentiality)的政治哲學思想。本論文的工作便是試圖詮釋阿岡本對於例外狀態的思想所具有的系統性,並予以評論。
