目前在我國擬議制定之「兩性工作平等法草案」及「男女兩性工作平等法草案」中,都設法加強有關救濟制度之建構,除一方面希望能對當事人提供較充分之法律保障外,並期能儘速尋求解決之道,而綜觀目前正在整合三項草案版本之相關內容,其設計師法美國制度之處頗多,諸如鼓勵事業單位建構內部申訴制度,並透過主管機關及兩性工作平等委員會提供相關之行政救濟,且在當事人尋求法院救濟時,提供必要之協助等構想,均與美國制度之做法相當類似。因此,對該國兩性工作平等救濟制度在過去三十多年來所累積之經驗,自有就適合我國國情部分加以援引擷取,俾便早日達成兩性工作平等之理念。 本文之目的,是要對美國兩性工作平等救濟制度做一整體之說明與評析,藉供我國建構相同制度時參考之用。除序言外,全文共分為七大部分:第一部分根據制定時間之先後,對該國保障兩性工作平等之重要制定法及總統行政命令等,做一簡要說明。第二部分討論該國平等就業機會委員會及聯邦契約遵循署之組織架構及重要職權。第三部分分析如何透過團體協約之訴怨程序及事業單位之內部申訴管道,來對當事人給予救濟。第四部分說明平等就業機會委員會及聯邦契約遵循署所能提供之行政救濟。第五部分則探討聯邦各級法院在這類事件所扮演之角色。第六部分是對該國相關制度做一整體評析,包括其優劣及引起爭議之處。最後,本文在結論中提出美國制度可供我國啟示之部分,藉供我國參考攻錯之用。
