The type of dispatched work has already existed many years in Taiwan, which is not forbidden by the current law, namely the dispatched works industry is nominally legal. Since the businesses and government have certain demand regarding the work dispatch, the dispatched works develop rapidly in recent years. No special branch of law regulates this atypical employment, which therefore creates many legal disputes. Some scholars then appealed to regulate the dispatched work. For the reference of legislation, this article introduces international labor convention 181(superscript st) of International Labor Organization (ILO), in June 3, 1997. The 181(superscript st) international labor convention admits the exits of private employment agencies, and regulate comprehensively the work dispatch. It is the first convention to give the dispatched work international labor standards. This paper also introduces the related Conventions and analyzes their contents. Furthermore, this article introduces the development of norms for dispatched work in Germany, US and Japan, which could serve as a good reference of legislation in Taiwan.
