我國近年隨著社會的進步,社會大眾開始重視婦女人身安全、兩性平等、婦幼人身自由等議題,特別是一連串重大性侵害引起大眾的恐懼害怕,在婦運團體、媒體、立委的大力支持倡導下制定相關性侵害犯罪防治法律,這些立法被稱為「超前立法,以美國為師」,但是除了美國外,包括加拿大、英、法、瑞典等歐州國家,以及日韓國家其他各國性侵犯社區處遇立法及刑事政策,也值得我們立法參考之處,而非只單依美國性侵害犯罪相關法律、政策作為我們性侵害犯罪防治法的藍本。我國性侵害社區處遇的法律及刑事政策,究竟是應以美國為師,採取社會防衛模式,以社會大眾安全為優先,或者應該像日本、瑞典等國家,以加害人社會復歸為主,重視犯罪者的權益,或者是應該學習加拿大、法國,強調社會防衛及社會復歸並重的性侵害社區處遇,值得研究。
本文研究內容,是主要以文獻分析法及比較刑事法學方式來蒐集的各國性侵犯社區處遇相關法律為依據(含立法例、立法背景、政策),作為本研究的研究架構及理論依據,來評估我國性侵犯社區處遇(電子監控、登記、治療處遇、終身監控)法律規定、實際執法之差異及缺失等情形,加予檢討,並分析理論與實務,政策面與執行面方差距,矛盾之處及缺失,對我國性侵犯社區處遇制度所呈現問題,提出確實可行的解決方案,以作為本研究之結論與建議,其目的不但可為將來修法及學術研究之參考,建構符合我國國情的本土化性侵犯社區加害人處遇制度,並提出修法參考。
Abstract
With the progress of society in Taiwan recently, the public starts to value the safety of women, gender equality, and right of personal freedom for women and children, particularly issues regarding public fears caused by a series of major sex offenses. The women’s groups, media and legislators strongly support and advocate for the legislation of relevant laws governing sex-crime prevention. Such legislation is known as “U.S. led advanced legislation.”
However, apart from the United States, Taiwan should also take consideration of the legislation of community-based correction for sex offenders and criminal policies from Canada, England, France, Sweden, Japan, Korea and other countries into legislation. Rather than solely formulating the blueprint for Taiwan’s sex-crime prevention law according to the relevant sex-crime law and policies of the United States, it merits further study to analyze if Taiwan should adopt social defense model led by the United States for Taiwan’s law and criminal policy of sex-crime community based correction, putting the safety of the public in priority; or learn from Canada and France by adopting sex assault community-based correction that emphasizes on both community defense and social restoration.
The study primarily applies literature analysis and compares criminal laws to collect laws related to community-based correction for sex offenders from different countries as the basis (including cases of legislation, legislation background, policy) of research framework and theoretical reference for the study. Laws, regulations, and difference and flaws in actual law enforcement on community-based correction for Taiwan’s sex offenders (electronic monitoring, registry, treatment and correction, lifetime monitoring) will be assessed and reviewed in this study.
Further analysis of theories and practices will be conducted to identify the difference between policies and execution, and areas and flaws of conflict and the issues presented through the community-based correction system for Taiwan’s sec offenders. The study intends to propose real and feasible solutions as conclusion and suggestions of the research, which not only can be used as reference for future law amendment and academic research but most importantly can be applied to build a local community-based correction for sex offenders that meet Taiwan’s customs, in addition to proposing suggestions related to law amendment.
