自從 1997 年複製羊桃莉的誕生開始報導後,社會大眾及媒體就集中在細胞核轉植技術是否可以用來複製人類胚胎之討論。複製技術(Cloning)在科學上的定義,係在細胞和有機體上,以無性生殖方式,製造出與其基因完全一樣的另一個個體之技術。複製技術不是為生殖目的(reproductive purposes),就是為生物醫學研究目的(purposes of biomedical research)在近日引發廣大的爭議。生殖性目的與生物醫學目的的生物可能性須從倫理與合憲性觀點,予以論證與檢視。本論文將以 2004 年德國倫理委員會「生殖性目的與生物醫學研究目的之間的複製技術之報告書」(Cloning for reproductive porposes and cloning for the purposes of biomedical research)為中心,從德國倫理委員會的觀點狀態了解先進國家的態度,以及國際間甚或其他國家的法律規範,我國衛生署相關人類胚胎幹細胞研究的相關規定也要一併在本論文當中,予以討論與介紹。
Since the birth of Dolly the cloned sheep was reported in 1997, public interest has focused also on the possibility of embryos of human beings by cloning using the technique of nuclear transfer. Cloning is defined scientifically as the asexual reproduction of cells or organisms to yield genetically identical individuals. However, cloning human beings, either for reproductive purposes or for purposes of biomedical research, is at present a extensively controversial issue. The biological possibilities of cloning human beings both for reproductive purposes and for purposes of biomedical research must from the ethical and constitutional aspects be discussed and surveyed. This dissertation focuses on Opinion ( 2004 ) of Germany Nationaler Ethikrat: “ Cloning for reproductive purposes and cloning for the purposes of biomedical research ”. We can from above Opinion ( 2004 ) understand the positions of cloning human beings in developed countries as well as the legal norms of other international countries. Furthermore,“ The Related Regulations for Research of Stem Cells from Human Embryos ” from the Department of Health ( DOH ) in Taiwan must in this dissertation be also discussed and introduced.
