1991年所簽署的《巴黎和平協定》象徵東南亞地區冷戰對抗的結束，和平與國家重建成為柬埔寨與國際社會共同努力的目標。然而，對於赤柬（Khmer Rouge）政權主政時期所犯下重大人權侵害罪刑之究責，卻直到1990年代末期才出現嚴肅地討論與呼籲。柬埔寨法院特別法庭作為轉型正義的制度產物，自2007年以後正式開始運作。本文的主要目的，在於分析特別法庭誕生的脈絡以及迄今之運作狀況，除了檢視影響混合式法庭運作的可能因素之外，並與量化文獻中所論證的嚇阻論邏輯進行比較，以謀進一步的理論反省。
The conviction of Khieu Samphan and Nuon Chea by the Extraordinary Chamber of the Courts of Cambodia (ECCC) on August 7, 2014, marked an important step of Cambodia’s enterprise for transitional justice. Nevertheless, the long overdue judgment suggests a trecherous rather than promising future facing the ECCC. Since its establishment, the ECCC has been criticized forby constant political interference and institutional defects. This article intends to offer a historical review of the creation and operation of the ECCC. Moreover, the performance of the ECCC is compared with other mixed courts to revisit the deterrence logic supported by quantitative literature. Finally, the possible approaches to continue the enterprise of transitional justice in Cambodia are discussed.
