　　　　　台灣社會如何從「屬民社會」到「公民社會」？公民教育理論，是否必須以「自主性」的理念為內涵？本文試圖從由現代法律體制的形成與其理念，檢討公民意識形成的問題。本文將以「現代性與法律理念」的關聯性的探討為出發，根據Jurgen Habermas所提出之現代性理論，指出現代性的結構性意含，於社會上與文化上均呈現不可避免的「反身化」(reflexive)過程，法律作為社會整合的機制，外部地於其形式上與結構上展現於其實證化之過程，內部地即展現於其自由與民主理念之開展。自主性，係「公民社會」與「屬民社會」之差異所在，公民教育理論，不可避免地須含自主性的理念。自主性的習得，須以學生主動為核心之教學法。再者，自主性，須於溝通互動之相互批判可能性之過程中形成，故公民資格之先決條件，在於溝通理性之成熟發展。
