從1980年代末期開始，兩岸旅遊交流迅速增長，但發展迄今，臺灣人民赴中國大陸旅遊者多，中國大陸人民來臺者少，成為一種不平衡的發展。此外，近年臺灣入境旅遊成長有限，而中國大陸出境旅遊又快速崛起，因此，政府也循序漸進地開放中國大陸民眾來臺旅遊。本文藉由全球化與混合經濟理論探究臺灣開放中國大陸民眾來臺旅遊之相關法制變遷，其中可區分為專業人士參訪、小三通與觀光旅遊等三種模式，但目前的開放幅度均相當有限。在可預見的未來，迨全面開放中國大陸人士來臺旅遊與兩岸直接通航後，對於臺灣之旅遊產業與兩岸關係勢必產生深遠影響。
At the end of the 1990's trips between Taiwan and China rapidly grew but the long-term status of Taiwanese visiting China has caused a severe imbalance. In addition, entry to Taiwan in recent years has been limited while outbound China tourists have grown. Thus, the government has gradually allowed visitors from China. This study uses globalization and mixed economy theory to explore the legal changes involved when visitors from China go to Taiwan. The visitors can be classified based on the three models of professional business, mini three links, and tourism. However, the degree of opening up is limited. The future full opening and direct links will have a significant impact on Taiwan's tourism industry and the relationship between the two parties.
