Except the local governments develop fast and have intact norms, the power of making regulations by other self-governing bodies are not only short of the basis of the law, but also short of the scholar’s research. The position of the self-governing bodies by the legal provisions represents to authorize the power of making regulations. Furthermore, the autonomy regulations must be in accordance with the Constitution Article.23. Unable to conflict with law, autonomy regulations must also be given a concrete authority to the self-governing bodies by the law; the self-governing bodies can just accord with this to make autonomy regulations, limit the rights of people, and realize the autonomy duty. This text studies the foundation, enforcement and demarcation line in the power of making regulations by self-governing bodies in terms of Taiwan legal system, trying to distinguish relevant theories, and delivering comments on Judicial Yuan Interpretation No.628 tentatively.
