There is a story behind every vendor. Since ancient times, the issue of vendors has been a very problematic policy issue for the government. Taking the Song Dynasty as an example, the famous Qingming Shanghe map can be found that the wooden signs are erected on the bridge head, the boundary line is defined, the street vendors are provided on both sides of the road, the central part is for the public to walk, and the method of managing the vendors in the Song Dynasty is established on the street. "Wood", also known as "signpost", is a two-point line. Outside the boundary between the two road signs, the people can be allowed to occupy the street. However, the area within the boundary (the center of the street) is forbidden. However, the people seem to be insatiable, and there are still many people who cross the border. Therefore, the government has to repeatedly emphasize it is not possible to cross the line. In order to solve the illegal behavior of encroaching on the streets, the implementation of tax collection also caused public grievances. Obviously, the errands of the City maintenance have become a pain in the hearts of all governments.
In January 1981, the Taiwan government transferred the business of the vendor to the industrial and commercial organization, and imposed a business tax on the vendor. However, the responsibility of managing the vendors is still on the police. Not only has the problem of the vendors not been resolved, but the police and the people often have conflicts. The administrative law enforcement in the early city administration areas of Mainland China was rather confusing. In the course of managing the vendors, there was a ridiculous phenomenon of multiple law enforcement and repeated punishments, such as "seven or eight big caps can not hold a straw hat". In order to avoid the recurrence of the above-mentioned ridiculous circumstances, since October 1, 1996, the local people''s governments have successively implemented city administration and law enforcement tasks in accordance with the provisions of Article 16 of the Law of the People''s Republic of China on Administrative Penalty, while the management of illegal vendors is the one of the businesses of the city administration and law enforcement department. After more than 20 years of exploration and improvement, the management of vendors in Mainland China has achieved results, which is worthy of reference by relevant administrative agencies in Taiwan.
The phenomenon of "street vendors" is closely related to the people. It is also known as the civilian economy. It has both the depth of history and the wide space of distance. This paper hopes to use the five major frameworks of administrative law to combine cross-strait vendor management to make the vendor management mechanism more robust and enhance people''s well-being.
