Article 85-1 of Taiwanese Government Procurement Act provides that under some circumstances the government cannot refuse disputes to be referred to arbitration. Many argue that it violates the Taiwanese Constitution, namely the right of access to the court as well as the equal protection of the law. This article addresses this issue, and concludes that the above Article 85-1 is neither a ”mandatory arbitration” provision, nor against the Constitution.
