題名:去界化與社區再生--縣市整併時社區軟治理初探

縣市整併時期,由於拆解了原本人為的行政疆界,並創作了新的人為之行政疆界,因此原本的行政疆界所構成的界限與領域之劃分,必須在此過程中予以融化。本文認為,社區的自我再生能力及社區運作的封閉性,會因縣市之整併,而更顯重要,因此,配合社區的自我再生性之運作,而運用軟性法律進行社區之軟治理,是值得嘗試與推廣的方案。而社區公約,可以作為社區軟治理的一項妥善的工具。但其前提是,吾人不能用傳統硬性法規的定性與標準,來設定社區公約之內容;相反的,應使社區公約的形成與制定,能夠充份地反應社區的自我再生邏輯。
The artificial boundary between communities will be dismantled during annexation of city and county. The autopoitic nature of community systems will be more and more important to the delivery of community public services. For following the autopoisis of community systems, it is proper to apply soft governance solutions to revive the autonomic of community. The community covenants are good tools for soft governance. However, the community covenants should not be a hard law for community but reply to the outcomes of community autopoisis.
