為滿足民間對於公共建設及服務的需求，政府期望透過引進民間的專業技術及豐沛資本，以提高政府的效率並減低財政負擔，有鑑於此，本文乃擬以促參法之「興建、營運與移轉」民間參與公共建設方式為例，並輔以桃園航空貨運園區BOT計畫案予以分析。 經分析發現：就專案融資方面，本文以為，政府應助民間業者融資、以及主辦機關宜提供公共建設最低營運量承諾;就財務評估以論，由於公、私部門存有歧異，本文認為，對公共建設之自償率計算與評估宜更審慎化，並利用協商以進行公、私部門間之財務評估調整及低自償性公共建設之妥善處理，更重要者，本文以為宜採不動產證券化方式，以提高民間私部門之獲益能力。 我國促參法修正在即，期待上述淺見能供作主管機關參考，以確實體現公私協力之精髓。
To enhance its administrative efficiency and reduce its financial burden, the private sector must be provided with better incentives to make it more motivated to invest in public infrastructure. Thus, the goal of this research is to analyze the response of (public) legal institutions to the “Act of the Improvement of the Incentives for the Private Sector’s Investment in Public Infrastructure.” To do this, we use the participation type of the so­called “Build, Operation and Transfer” (BOT) based on the example of “the Air- Transit Industrial Area” in Taoyuan County, Taiwan. After extensive analysis, we put forth two suggestions. First, as for “Project Financing” of the BOT type, the authority should be more careful when dealing with the “self-payment ratio” of its financing plan. It is clear that negotiations between the authority and the private sector are considerably helpful in resolving any potential problems. Secondly, on the question of improving the financial feasibility of the BOT type, the usage of real estate in “the Air- Transit Industrial Area” must be more diversified. Since the enforcement of the “Act of the Securitization of Real Estate” in 2003, for example, it has become much easier to deal with this issue. When the “Act of the Improvement of the Incentives for the Private Sector’s Investment in Public Infrastructure” is revised in the future, the authority should take the recommendations stated here into account. It is also hoped that an increasing number of “public-private partnerships” can be realized.
