General administrative act (Allgemeniverfuegung) is a concept adopted by Administrative Procedure Act in Taiwan, and it is seldom questioned. This concept has great influences in the quality of urban planning. In the Judicial Yuan Interpretation No. 156, it is understood that some types of urban planning are general administrative acts. However, there are still many arguments about the creation of this concept in the state of its origin - The German. Accordingly, this Article is going to study and review this concept from explanation and lawmaking ground. After study and review, this Article argues: The concept of general administrative act is not necessary; it makes no differences from order or regulation. The urban planning, including total review change or individual change, is always regulation, but not general administrative act. As for the right protection, we shall develop a special action system for the judicial review of the Urban Planning.
