1989年政府開始對外籍勞工採取開放的措施，合法化的引入泰國、菲律賓、印尼 與馬來西亞的勞工，進入台灣的勞動力市場，估計目前在台灣的合法外勞約為 25 萬人，約 佔台灣的勞動人口的 2.5%。 外勞雇用的過程，以及這個勞力市場形成的過程和這幾年之間 的變化，受相當複雜的政治社會制度的影響。這份研究的目的是以外籍勞工輸入所構成的人 力市場為對象，分析這個市場運作的特徵和變化，特別是在這個市場中，勞力仲介組織受到 國家政策的影響，而呈現出的特殊的「非理性」的市場行為。在理論分析上本文採取經濟社 會學觀點，說明外勞市場的鉅視結構和微視層次的交易與運作過程，與國家政策及法規的限 制有極為密切的關聯。國家的政策成為外勞市場的政治基礎，在這個制度基礎上，外勞的仲 介業者採取特殊的利益追求行動。對這些實踐行動的整體性理解，很難不考慮國家法律在外 勞市場中所產生的重要效應。

　　　　　In 1989 the government in Taiwan adopted an open policy that allowed workers from Thailand, the Philippines, Indonesia and Malaysia to work legally. It is estimated that there are 250,000 foreign workers in Taiwan that comprises 2.5% of total active labor. The aim of this article is to use economic sociological models to analyze the structure of the foreign workers market and the behavior patterns of local manpower companies that arranges international labor migration. We argue that high competition among the manpower agencies and the resultant kick-back strategies used to secure their contracts with users of foreign workers have been encouraged by related state policies. A comprehensive understanding of such market practices is difficult without considering effects of state laws and administrative actions.
