Since the “Liu Kuan-Jun Case” explored at last March, it made a disaster for our country in the leak of national classified secret and injury of the freedom of press; it also causes the extensive discussion and argument at that moment. The local “Next Media” magazine and “China times Evening News” had lead the first to published a lot of details of the case, even to conjectured the trends of the case, thus the procuratorial organ commanded the police to swept those medias, and causes a great disturbance in Taiwan. The “National Classified Secret Protection Law” had enacted under the background, hence, the “Government Information Announcement Act” has not passed simultaneously, and it made the regret for our legal system. The question is, whether there is a “gray zone” between the national security and press freedom? In my opinion, a modern nation should respect the “Rule of Law” principle (that is “Rechtsstaat” in German Public Law) and to protect the fundamental rights for mass people, that not to violate the principle of democracy and also the main purpose in my article. It also enumerates two famous cases to examine the illegal actions of the state, which abuse national security to slay the press freedom. Although the “gray zone” between the national security and press feedom damage our society regularly, the constitutionalism and legalism should be the supreme principle in our nation to protect the value of freedom.
