Als objektive Grundrechtsgehalt ist der Begriff staatlicher Schutzpflicht in der Judikatur des BVerfG worden. Zweifellos ist,d ass entweder die Judikatur oder die Lehre solchem Begriff nicht entgegengesetzt hat,a ber umstritten ist die Frage,wor aus die staatliche Schutzpflicht folgt. Deshalb muss diese Frage vorher behandelt werden. Ein anderes Probelm besteht darin,da ss es noch an einem konkreten Kriterium für Einzelfall fehlt. Ein Kriterium wird aus Literatur und Judikatur im Beitrag herausgebracht. Zum Schluss werden zwei Fälle als Beispiele,a lso Luftsicherheitsentscheidung des Bundesverfassungsgerichts und damit der Fall Daschner,e rwähnt und damit wird weiter über den Konflikt zwischen Abwehrrecht und Schutzpflicht diskutiert. Constitutional rights under the Basic Law guarantee civil liberties and constitute public duties,which play important roles in protecting citizens from harm, threat or even terrorism. German Constitution Court also confirms that protective function is the objective function of civil liberties by judgments. There is no doubt of concepts to protective function for German jurists. However,dif ferent opinions between doctrines and judgments are focused on how to derive concepts of protective function. Furthermore,jur ists have no complete model with common consensus to conflict of civil liberties. This research is an attempt to review relative judgments about protective function from the Court and to propose a hypothesis by utilizing Luftsicherheitsentscheidung, an aviation judgment,by the Court in 2006 and the Case Daschner to study practice of protective function and conflicts of civil liberties defence.
